AMOS Talent Network Advertising Membership Terms
Terms governing the optional paid AMOS Talent Network Advertising Membership operated by Aussie Remote Operations Pty Ltd (ABN 84 695 192 897), trading as AMOS – Australian Managed Offshore Solutions.
1. About These Terms
These Membership Terms apply to the AMOS Talent Network Advertising Membership supplied by Aussie Remote Operations Pty Ltd (ABN 84 695 192 897), trading as AMOS – Australian Managed Offshore Solutions (AMOS, we, us or our).
An AMOS Talent Network Advertising Membership is an optional professional profile-hosting, advertising and visibility service for Virtual Assistants and other remote professionals. It allows an approved member to showcase their professional services, experience, skills and availability through the AMOS Talent Network.
Membership does not guarantee employment, contractor work, interviews, client enquiries, business introductions, placements, income or any other paid work. Under this Membership Agreement, AMOS is not appointed to find work for the member.
Business access to talent, separately commissioned recruitment services, AMOS managed workforce services and optional career-support services are separate AMOS services and may be subject to separate terms, fees and agreements.
Purchasing or maintaining an Advertising Membership is not a requirement for participation in a separately operated AMOS recruitment process or separate work arrangement.
The membership plan, total price, billing interval and specific features presented to you before you accept and purchase your membership form part of your agreement with AMOS.
By purchasing or maintaining an AMOS Talent Network Advertising Membership, you agree to these Membership Terms together with the AMOS Privacy Policy and any additional terms expressly presented to you before purchase.
Nothing in these Membership Terms changes the legal character of the activities actually carried out by AMOS, a member or a business, or excludes any law, right or obligation that cannot lawfully be excluded.
2. Eligibility and Membership
To apply for an AMOS Talent Network Advertising Membership, you must:
be at least 18 years old and legally capable of entering into an agreement;
provide truthful, accurate, complete and current information;
have the right to provide and authorise the use of any professional information, photographs, portfolio material, videos, documents and links submitted;
be legally permitted to advertise and provide the professional services described in your profile;
comply with these Membership Terms and applicable AMOS professional standards; and
use the Talent Network lawfully, honestly and professionally.
Membership is available only in locations currently supported by AMOS. AMOS may restrict or decline applications from locations where legal, regulatory, payment, operational or other requirements have not been satisfactorily addressed.
A prospective member may submit profile information for private review before a paid membership is activated. Submission for review does not create a free public listing or guarantee approval.
AMOS may review an application and profile for accuracy, completeness, lawful content, professional presentation and suitability for publication on the Talent Network. AMOS may request reasonable corrections, clarification or supporting information before approving a profile.
AMOS may decline an application where the profile does not meet these Terms, applicable law or AMOS's published professional and publication standards. Where reasonably practicable, AMOS will explain the reason for a declined application or identify information that requires correction, unless doing so would compromise security, another person's rights or a legal obligation.
A paid membership will not commence until the profile has been approved and is ready for publication.
If AMOS takes a membership payment in error before approval and the profile is not published, AMOS will refund that membership payment and stop any associated recurring membership charges.
One membership applies to one professional profile and one individual unless AMOS expressly agrees otherwise.
Approval for publication does not mean that AMOS has independently verified every statement, qualification, skill, licence, reference or other claim made by the member. Any separate AMOS verification status is governed by clause 9.
3. Membership Fees and Billing
AMOS Talent Network Advertising Membership currently offers:
Monthly Membership — AUD $6 for one month
Annual Membership — AUD $60 for 12 months
The total price payable to AMOS, the selected membership period and the applicable billing arrangement will be clearly displayed before payment is authorised.
The prices stated above are the total membership amounts charged by AMOS for the relevant plan and include any GST or other tax that AMOS is required to include in the advertised price.
AMOS does not charge an additional compulsory setup fee or compulsory career-support fee as part of these membership plans.
A bank, card issuer, payment provider or currency-conversion provider may separately impose foreign-exchange, international transaction or other payment-related charges under its own agreement with the member. Those third-party charges are not set or retained by AMOS.
Membership fees are processed through the payment provider identified at checkout. Members must not send payment-card details to AMOS by ordinary email.
AMOS will provide or make available reasonable confirmation of a successful membership payment.
If a recurring payment fails, AMOS may notify the member and provide a reasonable opportunity to update or correct the payment method. AMOS may suspend publication after the already-paid membership period has expired if payment remains outstanding.
AMOS will not continue charging future membership periods while a subscription has been cancelled or terminated.
4. Automatic Renewal
AMOS Talent Network Advertising Membership is a recurring subscription unless the plan is expressly identified as non-renewing at the time of purchase.
A Monthly Membership renews for a further one-month period at the applicable renewal price unless cancelled before the next renewal charge is processed.
An Annual Membership renews for a further 12-month period at the applicable renewal price unless cancelled before the next renewal charge is processed.
Before a member authorises a recurring subscription, AMOS will clearly display the:
amount of the initial membership charge;
membership period;
recurring renewal amount;
frequency of renewal; and
method available to cancel future renewal.
By expressly authorising recurring billing at checkout, the member authorises the applicable payment provider to process recurring membership charges for the selected plan until the subscription is cancelled or otherwise ends.
Consent to receive marketing communications does not constitute consent to recurring membership charges.
AMOS will provide any renewal information, reminders or notices required by applicable law and may provide additional reminders as part of its membership service.
Any future change to the membership price will be dealt with in accordance with clause 17 and will not be applied retrospectively to a membership period that has already been paid for.
5. Cancellation
A member may cancel future renewal of their membership at any time before the next renewal charge is processed.
Cancellation may be completed using any cancellation facility made available through the member's account or payment provider, or by emailing amos@aussieremote.com.au with a clear request to cancel the membership.
AMOS will not require a member to telephone, purchase another service or complete an unnecessarily difficult process in order to cancel a subscription.
Cancellation stops future recurring membership charges. It does not ordinarily reverse or refund a membership fee that was properly charged for a membership period that has already commenced and has been correctly supplied merely because the member changes their mind.
Unless the member requests earlier profile removal, or the profile is lawfully suspended or removed under these Terms, the member may continue receiving the paid membership benefits until the end of the membership period already paid for.
A member may separately ask AMOS to hide or remove their public profile before the paid membership period expires. Requesting that a profile be hidden does not by itself entitle the member to a refund for an otherwise correctly supplied membership period.
Closing a member account will also cancel future membership renewal.
If AMOS processes a renewal charge after receiving a valid cancellation request before that renewal charge was due to be processed, AMOS will reverse or refund that charge.
Nothing in these Membership Terms excludes, restricts or modifies any consumer guarantee, refund right, cancellation right or other remedy that cannot lawfully be excluded, restricted or modified.
6. What Membership Includes
While an approved AMOS Talent Network Advertising Membership is active, the member receives the following core membership services:
one hosted professional AMOS Talent Network profile;
placement within relevant supported talent, skill, software, role and industry categories;
profile fields for professional experience, skills, qualifications, software knowledge, availability and other supported professional information;
supported portfolio, LinkedIn, professional website and introduction-video links where available;
the ability to maintain or request reasonable updates to profile information;
a business contact-request facility through which interested businesses may express interest in the member through AMOS;
eligibility for consideration for AMOS Talent Spotlight, Featured Talent and other editorial promotional opportunities; and
any additional membership features expressly included in the member's selected plan at the time of purchase.
AMOS may improve, expand, redesign or replace non-material features of the Talent Network as the service develops, provided that the core paid membership service is not materially reduced during an already-paid membership period except as permitted under these Terms or required by law.
Profile updates may be self-service or handled by AMOS depending on the systems available at the relevant time. Reasonable formatting, presentation and technical limitations may apply.
Membership does not include a guaranteed number of profile views, enquiries, introductions, interviews, social-media posts, promotional placements or work opportunities.
Eligibility for Talent Spotlight, Featured Talent or other editorial promotion does not guarantee selection or a particular frequency of promotion.
Future features that were not expressly included in the membership plan accepted at the time of purchase are not guaranteed membership benefits.
Membership purchases professional profile hosting, advertising, visibility and related Talent Network services. It does not purchase employment, recruitment consideration, guaranteed business introductions, placement services or AMOS verification.
7. No Guarantee of Work, Employment or Recruitment Outcome
AMOS Talent Network Advertising Membership does not guarantee:
employment;
interviews;
client enquiries;
business introductions;
freelance or contractor engagements;
placement with an AMOS client;
selection through an AMOS recruitment process;
any minimum number of opportunities;
any particular level of income; or
any other paid work.
Businesses and members make their own decisions about whether to request or accept an introduction, participate in an interview or enter into a direct engagement.
The Advertising Membership does not appoint AMOS to actively find work for the member and AMOS does not charge the member a finder's, recruitment or placement fee under this membership.
A person does not need to purchase or maintain an Advertising Membership, career-support service, coaching product or other paid AMOS product to be considered for a separately operated AMOS recruitment process or to enter into or continue a separate work arrangement with AMOS.
Paying for Advertising Membership does not give a member priority, preferential treatment or an improved ranking in a separate AMOS recruitment or candidate-selection process.
Selection for recruitment, managed workforce opportunities or other professional engagements is based on relevant matters such as suitability, skills, experience, availability, verified information and the requirements of the particular business or role.
AMOS may separately provide recruitment, matching, onboarding, managed workforce or other professional services under separate agreements and commercial arrangements.
Advertising Membership alone does not make the member an employee, contractor, partner, agent, franchisee or authorised representative of AMOS.
Any separate work arrangement involving AMOS requires a separate agreement and will be governed by its actual terms, circumstances and applicable law.
8. Profile Accuracy and Member Responsibilities
Members are responsible for ensuring that information supplied to AMOS is truthful, accurate, complete, current and not misleading.
Members must not knowingly provide false, misleading, fabricated or materially incomplete information concerning matters including their:
identity;
qualifications or certifications;
employment or engagement history;
professional experience;
skills or capabilities;
software or systems knowledge;
licences or registrations;
references;
availability;
location or time zone;
work rights or other relevant legal permissions; or
professional achievements.
Members must only advertise professional services they are legally permitted and appropriately qualified to provide.
Being listed on the AMOS Talent Network does not authorise a member to provide legal, tax, BAS, accounting, financial, migration, healthcare or other regulated professional services where a licence, registration, supervision arrangement or other legal authority is required.
Members must have the necessary rights and permissions for photographs, portfolios, work samples, videos, client examples and other material supplied to AMOS.
Members must not submit unredacted client files, patient information, financial records, identity documents, referee information, confidential business records or another person's private information as profile or portfolio material unless they have lawful authority to do so and AMOS has approved the manner in which it is provided.
AMOS may:
review profile information;
request reasonable evidence or clarification;
correct spelling, grammar, formatting and presentation;
organise information into appropriate Talent Network categories;
remove information that appears unlawful, misleading, unauthorised or inappropriate for publication; and
decline, temporarily hide or remove profile material in accordance with these Terms.
AMOS will not materially alter a member's qualifications, experience, professional history, availability, rates or other substantive professional claims without the member's approval, except where removal or correction is reasonably necessary to address misleading, unlawful or unauthorised material.
Members must notify AMOS within a reasonable time when information material to their professional profile changes.
AMOS may request updated information or supporting evidence where reasonably necessary to maintain the quality and integrity of the Talent Network.
9. AMOS Verification and Profile Status
Paid membership and AMOS verification are separate.
Membership can be purchased. AMOS verification cannot.
Payment for Advertising Membership does not automatically make a member AMOS Verified, AMOS Verified Professional or otherwise independently verified.
AMOS may display the following profile statuses:
Listed Member
A Listed Member has an approved professional profile published on the AMOS Talent Network.
Listed Member status confirms publication approval only. Unless a particular item is expressly identified as checked or verified by AMOS, information displayed on a Listed Member profile is based on information supplied by the member.
Listed Member status must not be interpreted as comprehensive vetting or verification.
AMOS Verified
AMOS Verified means that AMOS has completed:
an identity check; and
an additional review of selected core professional profile information against information or supporting material made available to AMOS.
The scope and date of the completed verification will be recorded by AMOS and may be identified on or in connection with the member's profile.
AMOS Verified does not mean that every statement, qualification, licence, work sample or professional claim has been independently verified unless that specific check is identified.
AMOS Verified Professional
AMOS Verified Professional is a higher professional review status.
A member receiving this status must first satisfy the AMOS Verified requirements and undergo additional professional review that may include:
review of relevant professional or employment experience;
professional reference or engagement-history checks where reasonably available;
an AMOS interview and communication assessment;
review of relevant portfolio or professional material; and
role-specific skills, systems or practical assessment where appropriate to the profession or role.
AMOS will identify the material checks actually completed rather than implying that every possible professional credential has been verified.
AMOS Featured Talent
AMOS Featured Talent is an editorial and promotional status.
Featured Talent may be selected by AMOS based on matters such as professional relevance, profile quality, presentation, experience, availability and current business demand.
Featured Talent is not a higher verification level and does not guarantee employment, enquiries, introductions or work.
Featured Talent status cannot be purchased.
Verification Generally
AMOS verification reflects the checks completed and information reasonably available at the time of review. It is not a guarantee of future performance, honesty, suitability for every role, regulatory registration, employment, work rights, client selection or future work.
Where appropriate, AMOS may display or make available information explaining the scope of a verification status and when it was last reviewed.
AMOS may request refreshed or additional information where existing verification information becomes outdated or where there has been a material change.
AMOS may correct, suspend, expire, downgrade or remove a verification or featured status where:
underlying information is no longer current;
information is inaccurate or misleading;
supporting evidence can no longer reasonably be relied upon;
the member no longer meets the applicable verification standard; or
continuing to display the status would create a reasonable legal, security, integrity or reputational risk.
Where reasonably practicable, AMOS will explain a material verification-status decision and allow the member to provide relevant corrective information.
10. Business Interest, Contact Requests and Introductions
Businesses may view professional profile information made available through the AMOS Talent Network and may submit an expression of interest or request to contact or be introduced to a member.
AMOS may require a business to provide information about itself, the proposed role, engagement or business requirement before AMOS facilitates further contact.
Members control the categories of personal and professional information that AMOS is authorised to make available within the visibility options offered by the Talent Network.
Before publication, the member will be asked to approve or otherwise authorise the professional profile information intended for its relevant audience.
Designated private information — including private telephone numbers, private email addresses, residential addresses, identity documents, financial information and private verification records — will not be publicly displayed as part of an ordinary Talent Network profile.
AMOS will not release designated private contact details or other protected information to a requesting business without the member's specific permission or another lawful authority for the disclosure.
Where the member gives permission for contact information or other additional information to be released to a particular business, AMOS may provide that authorised information for the agreed purpose.
A member may decline a business contact request, proposed introduction or opportunity without losing their Advertising Membership or being penalised under these Membership Terms.
AMOS may decline, delay, investigate or block a business contact request where AMOS reasonably suspects:
fraud or impersonation;
unlawful, unsafe or misleading activity;
misuse of member information;
unrelated marketing or solicitation;
unreasonable or inappropriate conduct;
a material privacy or security risk; or
another legitimate reason connected with protecting the member, the business, AMOS or the integrity of the Talent Network.
A business request does not guarantee that:
the member will accept contact;
AMOS will facilitate an introduction;
the business will proceed;
an interview will occur;
an engagement will result; or
AMOS will consider the proposed opportunity suitable.
AMOS does not guarantee that every business submitting an enquiry or contact request has undergone comprehensive due diligence unless AMOS expressly states that a particular check has been completed.
Where a business wants AMOS to undertake recruitment, sourcing, shortlisting, onboarding, workforce management or another service beyond the Advertising Membership contact-request function, that service is separate and may be subject to separate business terms and fees disclosed to the business.
A business may also be charged separately for access to particular Talent Network functionality where AMOS offers such a service. Any such charge is a business-side charge and does not create an additional recruitment, introduction or placement fee payable by the member under this Advertising Membership.
Any direct professional engagement agreed independently between a business and a member is between those parties unless AMOS expressly becomes a party under a separate written agreement.
An AMOS-managed engagement, Recruitment Only service or managed workforce arrangement is governed by the separate agreement applicable to that service.
11. Talent Spotlight, Featured Talent and Promotion
AMOS may select suitable members for additional editorial promotion through AMOS Talent Spotlight, Featured Talent, AMOS websites, social media, email communications or other AMOS promotional channels.
Selection is at AMOS's discretion and may take into account matters including:
profile quality and completeness;
professional experience;
skills and qualifications;
presentation and professionalism;
availability;
relevance to current business demand;
industry or role requirements;
verification status where relevant; and
the member's permission for the proposed promotional use.
Featured Talent status cannot be purchased and is separate from AMOS verification.
Advertising Membership does not include a guaranteed Talent Spotlight, Featured Talent position, social-media post, email feature, advertising campaign, promotional frequency or minimum amount of exposure.
Selection for additional promotion does not guarantee enquiries, introductions, interviews, employment, contractor engagements, client selection, income or other paid work.
Where promotion goes beyond displaying the member within the ordinary Talent Network profile or directory audience, AMOS will obtain any additional permission reasonably required for that promotional use.
A member may decline optional promotional opportunities without losing the core benefits of their Advertising Membership.
A member may withdraw permission for future optional promotion by contacting AMOS. AMOS will stop new use covered by that withdrawal and take reasonable steps to remove relevant AMOS-controlled promotional material, subject to clause 12 and any lawful retention requirement.
AMOS may change, suspend or remove Spotlight or Featured Talent status where reasonably necessary because of changed availability, professional relevance, inaccurate or outdated information, withdrawal of promotional permission, breach of these Terms, legal or reputational risk, or changes to AMOS promotional activities.
Any future paid promotional placement offered by AMOS must be separately identified and agreed. Paid promotion must not be represented as earned verification or Featured Talent status.
12. Member Content, Portfolios, Images and Videos
Members may provide professional material for use in their Talent Network profile, including:
profile photographs;
CV or career information;
qualifications and professional experience;
portfolio material;
introduction videos;
LinkedIn, professional website or portfolio links;
software and technical skills;
work samples; and
other relevant professional information.
Members retain ownership of their original content and must have all rights, permissions and consents necessary to provide that content to AMOS.
Members must not submit material that unlawfully infringes another person's copyright, confidentiality, privacy, intellectual property or other rights.
By submitting material for an authorised Talent Network profile, the member grants AMOS a non-exclusive, royalty-free licence to host, store, reproduce, resize, format, technically adapt and display that material only to the extent reasonably necessary to:
operate the member's authorised Talent Network profile;
provide the Advertising Membership;
display the member within authorised Talent Network categories and search functions; and
carry out promotional activities separately authorised by the member.
AMOS may permit its contracted hosting, technology and service providers to process member content where reasonably necessary to provide those services and subject to appropriate contractual, privacy and security controls.
This licence does not transfer ownership of member content to AMOS.
Unless separately authorised, the licence does not permit AMOS to:
sell the member's original content as a standalone product;
fabricate an endorsement by the member;
use private member information for unrelated advertising;
materially alter the meaning of the member's professional history, qualifications or experience;
create a synthetic representation of the member's face or voice for promotional purposes; or
use private member information to train a general-purpose artificial intelligence model.
AMOS may make ordinary formatting changes, image resizing, spelling corrections, layout adjustments and other non-substantive presentation changes without further approval.
AMOS will seek the member's approval before making a material alteration that changes the substance or meaning of their professional profile or identity.
AMOS may decline, temporarily hide or remove content that:
is unlawful;
is false or materially misleading;
appears fraudulent;
contains unauthorised confidential or personal information;
infringes another person's rights;
creates a security or privacy risk; or
materially fails to meet AMOS's published professional or publication standards.
A member may request removal of specific profile content or withdraw publication permission.
If removal of essential profile content means AMOS can no longer reasonably provide the Advertising Membership, AMOS may require the member to update the profile or cancel the membership.
When a profile is removed, membership expires or relevant permission is withdrawn, AMOS will stop new publication or promotional use of the affected content and take reasonable steps to remove current AMOS-controlled copies within a reasonable period.
Material previously indexed by search engines, cached, shared by authorised third parties or otherwise outside AMOS's reasonable control may remain available after AMOS removes its own copy.
AMOS may retain limited copies where reasonably necessary for:
accounting and payment records;
legal or regulatory compliance;
fraud, security or dispute records;
backup and disaster-recovery systems; or
other lawful record-retention purposes.
Material retained for those purposes will not remain available for ordinary public Talent Network browsing merely because AMOS retains a restricted copy.
13. Prohibited Conduct and Protection of the Talent Network
Members must not use the AMOS Talent Network to:
provide false, fabricated or materially misleading professional information;
impersonate another person or organisation;
submit fraudulent qualifications, references, licences, credentials or employment history;
upload material they do not own or have authority to use;
publish confidential or personal information without lawful authority;
engage in unlawful, abusive, discriminatory, threatening, intimidating or harassing conduct;
distribute malware, malicious code, spam or deceptive material;
interfere with, probe, damage or attempt to obtain unauthorised access to AMOS systems, accounts or information;
misuse business enquiries, member information or contact information;
send unrelated or unlawful marketing communications using information obtained through the Talent Network;
scrape, harvest, copy or bulk-extract Talent Network profiles or information without AMOS's written permission;
resell, sublicense or provide unauthorised third-party access to Talent Network information;
create or assist in creating a competing personal-information, talent or candidate database using information obtained from the Talent Network;
use another person's Talent Network information to train an artificial intelligence model or automated dataset without lawful authority;
circumvent AMOS access controls or privacy settings;
misrepresent AMOS verification, Listed Member, Featured Talent or other AMOS status;
reproduce or use AMOS verification badges without authority;
falsely represent themselves as an employee, contractor, partner, representative or authorised agent of AMOS; or
otherwise use the Talent Network in a way that creates a material legal, privacy, security or integrity risk for AMOS, members or businesses.
Nothing in this clause prevents a member from:
exercising a legal right;
making a genuine complaint;
reporting suspected misconduct;
cooperating with a regulator or law-enforcement authority; or
making lawful criticism of AMOS or another person.
Members and businesses may report suspected fraud, impersonation, intellectual-property infringement, privacy concerns, unsafe proposals, misuse of information or other serious concerns to amos@aussieremote.com.au.
AMOS may investigate suspected misuse and request information reasonably necessary to assess the concern.
AMOS may take proportionate action under clause 14 where AMOS reasonably considers action necessary to protect members, businesses, AMOS, its systems or the integrity of the Talent Network.
Nothing in these Membership Terms authorises a member or business to demand or collect from another member any unlawful recruitment bond, work-finding fee or other payment prohibited by applicable law.
14. Suspension, Restriction and Termination
AMOS may temporarily restrict, suspend or permanently remove a profile or membership where AMOS reasonably considers that one or more of the following applies:
the member has materially breached these Membership Terms;
an applicable membership payment remains unpaid after the already-paid membership period has expired;
materially false or misleading information has been supplied;
fraudulent, altered or unreliable documentation or credentials have been identified;
another person's intellectual property, confidential information or personal information has been used without authority;
AMOS verification, branding or status indicators have been materially misused;
the member has engaged in serious abusive, threatening, fraudulent or unlawful conduct;
the membership or Talent Network is being used for an unlawful purpose;
the member has created or contributed to a material security, privacy, fraud or integrity risk;
continuing publication may reasonably expose AMOS, another member, a business or another person to material harm or legal risk; or
AMOS is required or reasonably directed to act by law, a regulator, court, payment provider, hosting provider or other competent authority.
Where an issue is reasonably capable of being corrected and urgent action is not required, AMOS will normally:
explain the material concern;
give the member a reasonable opportunity to respond or correct the issue; and
consider relevant information provided by the member before permanent termination.
AMOS will ordinarily allow at least seven calendar days to correct a remediable issue unless a shorter period is reasonably necessary because of the circumstances or applicable law.
AMOS may take immediate temporary or permanent action without first providing a correction period where reasonably necessary to address:
suspected fraud;
serious threats or harassment;
deliberate deception;
unlawful content or activity;
material privacy or cyber-security risk;
misuse of another person's identity;
serious risk to another member or business; or
a legal or regulatory requirement.
Where reasonably practicable and lawful, AMOS will provide the member with a reason for a material suspension or termination decision and an opportunity to provide relevant information or request review.
AMOS is not required to disclose information where disclosure would:
breach another person's privacy or confidentiality;
compromise fraud or security controls;
prejudice an investigation;
expose another person to risk; or
breach a legal obligation.
Suspension or termination does not affect rights or obligations that accrued before the effective date.
Permanent termination will stop future recurring membership charges.
Where AMOS permanently ends a membership for reasons unrelated to a material breach by the member, AMOS will refund any material unused portion of a prepaid membership period where appropriate.
Where termination arises from the member's material breach, fraud, unlawful conduct or other serious misconduct, any refund entitlement will be assessed having regard to:
services already supplied;
the circumstances leading to termination;
any proven amount lawfully owed to AMOS; and
rights and remedies that cannot lawfully be excluded.
AMOS will not impose an arbitrary penalty or automatic forfeiture unrelated to the service supplied or loss lawfully recoverable by AMOS.
If AMOS restricts or suspends a membership because of an AMOS error, AMOS will take reasonable steps to correct the error and appropriately address any material loss of paid membership service.
15. Privacy and Personal Information
AMOS collects, uses, stores and discloses personal information where reasonably necessary to operate the Talent Network and related AMOS services.
This may include purposes such as:
membership administration;
profile review and publication;
verification;
account management;
business contact requests and introductions;
communications;
payments and subscription administration;
fraud prevention;
security;
legal and regulatory compliance;
service administration and improvement; and
other purposes described in the AMOS Privacy Policy or notified at the time information is collected.
AMOS distinguishes between different categories of member information.
Public or Authorised Profile Information
This is professional information the member has authorised AMOS to display to the public or another defined Talent Network audience.
It may include information such as the member's professional name, photograph, role, skills, experience, qualifications, software knowledge, portfolio information and availability.
Restricted Business-Access Information
Certain information may be made available only to permitted businesses or recipients in accordance with the member's authorisation, AMOS access controls and applicable law.
Access to restricted information does not give a business ownership of that information or permission to use it for unrelated marketing, resale or another unauthorised purpose.
Private AMOS Information
Information retained privately by AMOS may include:
private email addresses and telephone numbers;
residential or private addresses;
identity-verification information;
payment or billing information;
private correspondence;
reference information;
verification records;
complaint, security or investigation records; and
other information not authorised for ordinary Talent Network display.
Private AMOS information will not be included in ordinary public profiles unless the member has specifically authorised the disclosure and the disclosure is otherwise lawful.
Where member permission is required before information is disclosed to a business or other person, AMOS will obtain and act within the scope of that permission.
Personal information is handled in accordance with the AMOS Privacy Policy and applicable privacy law.
AMOS may use contracted service providers to support website hosting, communications, payments, administration, security, analytics, verification or other legitimate business functions.
Some service providers, members, businesses or other authorised recipients may be located outside Australia.
Where required by applicable privacy law, AMOS will take reasonable steps in relation to overseas disclosure and will identify in its Privacy Policy or relevant collection notices the countries or categories of overseas recipients reasonably required to be disclosed.
AMOS will not represent that all personal information is stored or processed exclusively in Australia unless that representation is factually correct.
AMOS will use reasonable administrative, technical and organisational safeguards appropriate to the nature of the information held.
AMOS will retain personal information only for as long as reasonably necessary for legitimate business, contractual, security, dispute, recordkeeping or legal purposes.
Removal of a public Talent Network profile does not necessarily require immediate deletion of all records where AMOS has a lawful or legitimate reason to retain restricted information.
Members may request access to or correction of personal information held by AMOS in accordance with the AMOS Privacy Policy and applicable law.
Members may also raise privacy concerns or complaints by contacting amos@aussieremote.com.au.
Where applicable law requires AMOS to provide additional information about automated systems that make or materially inform decisions affecting individuals, that information will be included in the AMOS Privacy Policy or other required notice.
16. Intellectual Property
The AMOS name, logos, branding, website design, Talent Network structure, verification badges, status graphics, original written materials, graphics, systems and other content owned by AMOS remain the intellectual property of AMOS or its licensors.
Advertising Membership gives a member only the limited rights necessary to use the Talent Network in accordance with these Membership Terms. It does not transfer ownership of AMOS intellectual property.
Members must not copy, reproduce, alter, distribute or use AMOS branding, verification badges, status graphics or other protected AMOS material in a manner that:
falsely suggests endorsement, verification, employment, partnership or authority from AMOS;
misrepresents the member's current status;
creates confusion about a relationship with AMOS; or
otherwise infringes AMOS's intellectual-property rights.
A member may accurately describe their current AMOS membership or verification status while that status remains valid.
Any use of an AMOS verification, Featured Talent or other status badge is subject to any conditions supplied by AMOS and may be withdrawn when:
the relevant status expires or is removed;
the membership ends;
the badge is being used inaccurately or misleadingly; or
AMOS reasonably determines that continued use is no longer authorised.
Members retain ownership of their own original content, subject to the limited permissions granted to AMOS under clause 12.
Nothing in these Membership Terms transfers ownership of a member's original professional content to AMOS or ownership of AMOS intellectual property to a member.
17. Changes to Membership, Features, Pricing or Terms
AMOS may reasonably update, improve, redesign or change the Talent Network as the service develops.
AMOS may make non-material operational, technical, security, layout or feature changes where those changes do not materially reduce the core paid membership service.
AMOS may also introduce additional features, services or membership options. A new feature is not automatically included in an existing membership unless AMOS expressly states that it is included.
Where AMOS proposes:
an increase to a member's recurring membership price; or
another materially adverse change to these Membership Terms or the core paid membership service,
AMOS will provide affected members with at least 30 days' notice, unless a different period is required by applicable law or urgent legal or security circumstances make advance notice impracticable.
A membership price increase will only apply from a future renewal after the applicable notice period.
AMOS will not retrospectively increase the price of a membership period that has already been paid for.
The price and core paid membership benefits applying to an already-paid annual membership period will not be materially reduced through a mid-period price change.
Where AMOS materially removes or reduces an agreed core paid benefit during a prepaid membership period and cannot provide a reasonably equivalent replacement, the affected member may cancel the membership and may be entitled to an appropriate refund for the materially unused portion of the affected service, subject to applicable law.
A member who does not wish to continue following a notified future price increase or materially adverse change may cancel future renewal before the change takes effect.
AMOS may make changes required by law, regulation, security requirements, payment-provider requirements or other circumstances outside AMOS's reasonable control. Where advance notice is not reasonably practicable, AMOS will provide information about a material change as soon as reasonably practicable.
Where applicable law requires fresh consent or authorisation for a particular change, AMOS will obtain that consent or authorisation rather than relying solely on a change to these Membership Terms.
Nothing in this clause excludes or restricts any right or remedy that cannot lawfully be excluded or restricted.
18. Refunds and Mandatory Consumer Rights
Membership fees are not ordinarily refundable merely because a member:
changes their mind after the service has been correctly supplied;
no longer wishes to maintain a profile;
does not receive a particular number of profile views;
does not receive a business enquiry or introduction;
is not selected for Talent Spotlight or Featured Talent;
does not receive an interview;
does not obtain employment, contractor work or another paid engagement; or
cancels part-way through an already-paid membership period.
A lack of employment, interviews, introductions, enquiries or income is not by itself a failure to provide the Advertising Membership where AMOS has supplied the profile-hosting, advertising and related services that were purchased.
Nothing in these Membership Terms excludes any consumer guarantee, refund, cancellation, compensation or other remedy that applicable law does not permit AMOS to exclude.
Where applicable, a full refund will ordinarily be provided for:
a membership payment incorrectly taken before profile approval where the profile is not published;
a duplicate membership charge;
a renewal charge processed after AMOS received a valid cancellation request before that renewal was due; or
another charge that AMOS agrees was processed in error.
Where AMOS permanently closes the relevant paid membership service or permanently terminates a membership for reasons unrelated to a material breach by the member, an appropriate refund may be provided for a material unused portion of a prepaid membership period.
Where AMOS materially fails to provide a paid service, the member may be entitled to a refund, re-supply, extension or another remedy depending on the nature of the failure and applicable law.
A change-of-mind refund is not required merely because a member later decides that the Advertising Membership did not produce the commercial outcome they hoped for.
A member who believes that an incorrect charge, duplicate payment, service failure or other billing issue has occurred should contact amos@aussieremote.com.au so AMOS can investigate the matter.
AMOS will not require a member to waive a legal right, legitimate complaint or lawful payment dispute as a condition of receiving a refund to which the member is entitled.
19. Responsibility and Liability
AMOS is responsible for providing the Advertising Membership services it agrees to supply with reasonable care and skill and for complying with legal obligations that apply to AMOS.
AMOS does not guarantee a member's employment, commercial success, income, suitability for a particular business or the independent decisions of businesses or members.
Members remain responsible for assessing whether a proposed business, role, client, engagement or opportunity is appropriate for them before agreeing to proceed.
Businesses remain responsible for their own assessment and engagement decisions unless AMOS expressly assumes a particular responsibility under a separate written agreement.
Unless AMOS expressly becomes a party under a separate written agreement, AMOS is not a party to a direct professional engagement independently entered into between a business and a member.
Each business and member remains responsible for representations, commitments and obligations they independently make to the other.
To the extent permitted by applicable law, AMOS is not responsible for loss caused solely by:
a business deciding not to contact, interview or engage a member;
a member declining an opportunity;
inaccurate information independently provided by a business or member that AMOS did not know, and could not reasonably have been expected to know, was inaccurate;
a direct arrangement independently entered into between a member and a third party;
unauthorised conduct by an independent third party that AMOS did not cause or materially contribute to; or
events outside AMOS's reasonable control.
This does not exclude responsibility that AMOS may have for its own:
misleading representations;
negligent acts or omissions;
material breach of these Membership Terms;
privacy or security failures;
unlawful conduct; or
obligations expressly accepted under a separate AMOS agreement.
Members must take reasonable steps to avoid or reduce loss where reasonably possible.
Nothing in these Membership Terms excludes, restricts or modifies any liability, consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified.
20. Complaints and Disputes
AMOS encourages members to raise genuine concerns promptly so they can be reviewed and, where possible, resolved practically.
Complaints concerning membership, billing, profiles, verification, privacy, business contact requests, suspension, termination or other Talent Network matters may be sent to:

A complaint should provide sufficient information for AMOS to understand and investigate the issue.
AMOS may request reasonable supporting information where necessary.
AMOS will review complaints fairly and will aim to acknowledge a complaint promptly and ordinarily within two business days.
AMOS will aim to provide a substantive response or meaningful progress update within 10 business days, unless:
the matter is unusually complex;
information is required from the member or another person;
a fraud, privacy or security investigation is underway;
a shorter timeframe applies under applicable law; or
another reasonable circumstance requires additional time.
Where additional time is reasonably required, AMOS will endeavour to explain the reason and provide a further update.
Where reasonably practicable, a member may request that a material suspension, verification or termination decision be reviewed by someone who was not solely responsible for the original decision.
Nothing in this clause requires a member to give up any legal right or prevents a member from:
contacting an appropriate regulator;
exercising a lawful payment-dispute right;
seeking urgent legal relief; or
pursuing another remedy available under applicable law.
21. Governing Law and General Provisions
These Membership Terms are governed by the laws applicable in Queensland, Australia, subject to any mandatory law that also applies.
Courts and tribunals having jurisdiction in Queensland have non-exclusive jurisdiction in relation to these Membership Terms.
Nothing in this clause removes any mandatory legal right, consumer protection or jurisdiction available to a member that cannot lawfully be excluded.
For a member located outside Australia, mandatory laws that lawfully apply in that member's jurisdiction may continue to apply despite the Queensland governing-law provision.
If a provision of these Membership Terms is unlawful or unenforceable, that provision will apply only to the extent it can lawfully operate or, where appropriate, will be severed without affecting the remaining provisions.
A failure by AMOS or a member to exercise a contractual right immediately does not automatically waive that right.
Electronic notices may be sent using the contact information associated with the membership account or otherwise supplied by the member.
Members are responsible for keeping their contact information reasonably current.
Nothing in these Membership Terms permits AMOS to rely on a contractual provision in a way that would override a mandatory legal notice, cancellation or consumer right.
