AMOS Talent Network Membership Terms

Terms governing paid membership of the AMOS Talent Network operated by Aussie Remote Operations Pty Ltd (ABN 84 695 192 897).

1. About These Terms

These Membership Terms govern paid membership of the AMOS Talent Network, operated by Aussie Remote Operations Pty Ltd (ABN 84 695 192 897) trading as AMOS – Australian Managed Offshore Solutions.

By purchasing or maintaining an AMOS Talent Network membership, you agree to these Membership Terms together with the AMOS Privacy Policy and any other terms expressly presented to you at the time of joining.

The AMOS Talent Network is a professional profile, visibility and talent-discovery service for Virtual Assistants and other remote professionals. It is not an employment agency guarantee, job guarantee or promise of paid work.

2. Eligibility and Membership

To join the AMOS Talent Network, you must:

  • be legally capable of entering into an agreement;

  • provide accurate and current information;

  • have the right to provide the professional information, portfolio material, images and links submitted;

  • comply with AMOS professional standards; and

  • use the service lawfully and professionally.

AMOS may review applications and profiles before publication.

Purchasing membership does not guarantee that a profile will be approved or remain published where the member does not meet AMOS standards or these Terms.

3. Membership Fees and Billing

AMOS Talent Network currently offers:

Monthly Membership — $6 AUD per month

Annual Membership — $60 AUD per year

The applicable membership fee will be shown before payment.

Membership fees are charged using the payment method selected at checkout.

Unless otherwise stated, prices displayed are in Australian dollars.

Any applicable taxes or payment charges will be disclosed where required.

4. Automatic Renewal

Membership is a recurring subscription.

Monthly memberships automatically renew every month until cancelled.

Annual memberships automatically renew every 12 months until cancelled.

By purchasing a membership, you authorise the selected payment provider to charge the applicable recurring membership fee to your nominated payment method until the membership is cancelled.

AMOS will not deliberately conceal renewal conditions, minimum periods or mandatory charges. The renewal arrangement should also remain clearly displayed at checkout.

5. Cancellation

Members may cancel future renewal of their membership in accordance with the cancellation method made available by AMOS or its payment provider.

Cancellation stops future recurring charges but does not ordinarily reverse a payment already properly processed for the current membership period.

Unless required otherwise by law, membership access may continue until the end of the already-paid membership period.

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under the Australian Consumer Law. Australian consumer guarantees cannot simply be removed by contract terms.

6. What Membership Includes

An active AMOS Talent Network membership provides access to the membership features made available by AMOS from time to time.

Membership may include:

  • a professional AMOS Talent Network profile;

  • listing within relevant talent, skill, software and industry categories;

  • display of professional experience, qualifications and availability;

  • portfolio, LinkedIn and introduction-video links where supported;

  • the ability to request reasonable profile updates;

  • protected business introduction opportunities through AMOS;

  • eligibility for selected AMOS Talent Spotlight and promotional opportunities; and

  • access to future member features introduced by AMOS.

Features may be improved, changed or expanded as the AMOS Talent Network develops.

Membership provides professional visibility and related membership services. It does not purchase employment, client introductions or AMOS verification.

7. No Guarantee of Work or Employment

AMOS does not guarantee that membership will result in:

  • employment;

  • interviews;

  • client enquiries;

  • business introductions;

  • freelance or contractor engagements;

  • placement with an AMOS client;

  • any minimum number of opportunities;

  • any particular level of income; or

  • any other paid work.

Businesses make their own decisions about whether to request an introduction, interview or engage a member.

AMOS may assist with introductions, recruitment or managed workforce arrangements, but membership itself does not create an employment relationship between the member and AMOS.

8. Profile Approval and Member Responsibilities

Members are responsible for ensuring that information supplied to AMOS is truthful, accurate, current and not misleading.

Members must not knowingly provide false or misleading information about their:

  • identity;

  • qualifications;

  • employment history;

  • experience;

  • skills;

  • software knowledge;

  • references;

  • availability;

  • location;

  • work rights; or

  • professional achievements.

AMOS may review, edit for presentation, request clarification of, decline to publish or remove profile material where reasonably necessary to maintain the quality, accuracy and professional standards of the Talent Network.

Members should notify AMOS when material profile information changes.

9. AMOS Verification

Paid membership and AMOS verification are separate.

Membership can be purchased. AMOS verification cannot.

AMOS may offer different profile statuses, including:

Listed Member — a profile reviewed and approved for publication on the AMOS Talent Network.

AMOS Verified — a member for whom AMOS has completed additional identity and core profile checks.

AMOS Verified Professional — a higher review level that may include additional checks relating to experience, suitability, references, communication or professional presentation.

AMOS Featured Talent — a member selected by AMOS for additional visibility based on profile quality, presentation or suitability. Featured Talent status is separate from verification.

The checks undertaken may vary depending on the member, profession, role, information available and level of verification.

Verification does not guarantee employment, performance, suitability for every role, client selection or future work.

AMOS may withdraw or amend a verification or featured status if information later becomes inaccurate, outdated, misleading or inconsistent with AMOS standards.

10. Business Introductions

Businesses may request an introduction to a member through AMOS.

To protect member privacy, AMOS may withhold personal contact details from publicly displayed profiles and manage initial introductions between businesses and members.

An introduction request does not guarantee that:

  • the member will accept the opportunity;

  • the business will proceed;

  • an interview will occur;

  • an engagement will result; or

  • AMOS will consider the proposed opportunity suitable.

AMOS may contact either party to obtain additional information before facilitating an introduction.

Where a business requires recruitment, onboarding, workforce management or other services beyond a Talent Network introduction, separate AMOS service terms and fees may apply.

11. Talent Spotlight and Featured Status

AMOS may select members for additional promotion through AMOS Talent Spotlight, Featured Talent, social media, website features, email campaigns or other promotional activities.

Selection is at AMOS's discretion and may consider factors such as profile quality, experience, presentation, availability, professionalism, skills and relevance to current business demand.

Featured status cannot be purchased and is separate from AMOS verification.

Being selected for additional promotion does not guarantee enquiries, introductions, interviews, employment, engagement or income.

AMOS may change or remove promotional or featured status at any time where reasonably necessary.

12. Content, Portfolio, Images and Videos

Members may provide professional content for their Talent Network profile, including:

  • profile photographs;

  • CV or career information;

  • qualifications and experience;

  • portfolio examples;

  • introduction videos;

  • LinkedIn or professional profile links;

  • software and technical skills;

  • work samples; and

  • other relevant professional information.

Members must only provide material that they own or are authorised to use.

By submitting content for publication, the member gives AMOS permission to use, reproduce, format, resize and display that content for the purpose of operating and promoting the AMOS Talent Network and the member's professional profile.

This permission includes reasonable promotion of the member through AMOS websites, social media and Talent Spotlight activities while the relevant content remains authorised for use.

Members remain responsible for ensuring that submitted material does not infringe another person's copyright, privacy, confidentiality or other rights.

AMOS may decline, edit for presentation, temporarily hide or remove content that does not meet AMOS professional standards.

13. Prohibited Conduct

Members must not use the AMOS Talent Network to:

  • provide false or misleading professional information;

  • impersonate another person;

  • submit fraudulent qualifications, references or work history;

  • upload material they are not authorised to use;

  • engage in unlawful, abusive, discriminatory or threatening conduct;

  • attempt to compromise AMOS systems or another person's information;

  • distribute malware, spam or deceptive material;

  • misuse business enquiries or contact information;

  • misrepresent AMOS verification or featured status;

  • claim to represent AMOS without written authority; or

  • otherwise use the Talent Network in a way that may reasonably damage members, businesses, AMOS or the integrity of the network.

AMOS may investigate suspected misuse and request supporting information where reasonably necessary.

14. Suspension or Termination

AMOS may suspend, restrict or remove a membership or profile where reasonably necessary, including where:

  • these Membership Terms are materially breached;

  • membership fees remain unpaid;

  • information supplied is materially false or misleading;

  • fraudulent documentation or credentials are identified;

  • the member misuses AMOS verification or branding;

  • serious professional or behavioural concerns arise;

  • the service is being used unlawfully;

  • the member creates a material security or privacy risk; or

  • continued publication would reasonably place AMOS, businesses or other members at risk.

Where appropriate, AMOS may give the member an opportunity to provide information or correct an issue before taking permanent action.

Serious fraud, unlawful conduct, security threats or other serious misconduct may result in immediate suspension or removal.

Termination or suspension does not remove any rights or obligations that accrued before the effective date of termination.

Any refund entitlement following termination will be determined in accordance with these Terms and any rights that apply under Australian law.

15. Privacy and Personal Information

AMOS collects and handles personal information for purposes associated with operating the Talent Network, including membership administration, profile publication, verification, business introductions, communications, payments, security and service improvement.

Information that may be publicly displayed on a Talent Network profile will be distinguished from information retained privately by AMOS.

AMOS may protect personal contact information by allowing businesses to submit a Request an Introduction rather than displaying a member's private email address, telephone number or other contact details publicly.

Personal information is handled in accordance with the AMOS Privacy Policy and applicable privacy law.

Because AMOS operates an international remote talent network, information may in some circumstances involve service providers or recipients located outside Australia. The Privacy Policy should explain the types of overseas disclosures that are reasonably likely and, where practicable, the countries involved. Current OAIC guidance specifically addresses transparency around likely overseas disclosures and cross-border handling of personal information. OAIC

Members may contact AMOS regarding access to or correction of their personal information in accordance with the Privacy Policy and applicable law.

16. Intellectual Property

The AMOS name, branding, website design, Talent Network structure, verification badges, written materials, graphics, systems and other AMOS-owned content remain the intellectual property of AMOS or its licensors.

Membership does not transfer ownership of AMOS intellectual property to a member.

Members must not copy, reproduce, alter or use AMOS branding, verification badges or other protected material in a way that falsely suggests endorsement, verification, employment, partnership or authority from AMOS.

Members retain ownership of their own original content submitted to AMOS, subject to the permissions granted under these Membership Terms for operating and promoting their Talent Network profile.

Any permission to use AMOS verification or status badges may be withdrawn when the relevant status ends or where the badge is being misused.

17. Changes to Membership, Features or Pricing

AMOS may reasonably update, improve or change Talent Network features as the service develops.

Where a change materially affects a paid membership benefit, AMOS will take reasonable steps to communicate the change to affected members.

AMOS may change future membership pricing.

For monthly memberships, a price change will not apply retrospectively and members will be given reasonable notice before the new price is charged.

For annual memberships, any price change will ordinarily apply from the member's next annual renewal unless otherwise agreed or required by law.

Where a member does not wish to continue following a notified price change, they may cancel future renewal before the new price takes effect.

Nothing in this clause allows AMOS to remove rights that cannot lawfully be excluded.

18. Refunds and Australian Consumer Law

Membership fees are generally not refundable merely because a member:

  • changes their mind;

  • no longer wishes to maintain a profile;

  • does not receive an enquiry or introduction;

  • is not selected for Talent Spotlight or Featured Talent status;

  • does not obtain employment or paid work; or

  • cancels part-way through an already-paid membership period.

However, this does not exclude any refund, cancellation, compensation or other remedy to which a person is entitled under applicable law.

Where the Australian Consumer Law applies, AMOS services come with consumer guarantees that cannot be excluded.

Australian consumer rights cannot be removed simply by stating that refunds are unavailable. ACCC

If a member believes there has been an incorrect charge, duplicate payment, service failure or other billing issue, they should contact AMOS so the matter can be reviewed.

19. Liability

AMOS provides the Talent Network as a professional profile, visibility, discovery and introduction service.

AMOS does not control and is not responsible for the independent hiring, engagement, employment or commercial decisions made by businesses or members.

Members remain responsible for assessing whether any proposed role, business, client, engagement or opportunity is suitable for them before entering into an arrangement.

Businesses remain responsible for their own decisions when assessing or engaging talent.

To the extent permitted by law, AMOS is not responsible for losses arising solely from:

  • a business deciding not to contact, interview or engage a member;

  • a member declining an opportunity;

  • information independently supplied by another member or business;

  • an arrangement entered into directly between a member and a third party; or

  • circumstances outside AMOS's reasonable control.

Nothing in these Membership Terms excludes, restricts or modifies any liability, consumer guarantee or other right that cannot legally be excluded, restricted or modified.

20. Complaints and Disputes

AMOS encourages members to contact us promptly if they have a concern about their membership, billing, profile, verification status, privacy, business introduction or use of the Talent Network.

AMOS will take reasonable steps to review complaints fairly and may request supporting information where necessary.

AMOS may communicate with the member to clarify the issue and seek a practical resolution.

Nothing in this clause prevents a member from exercising any legal right, contacting an appropriate regulator or pursuing another remedy available under applicable law.

21. Governing Law

These Membership Terms are governed by the laws applicable in Queensland, Australia.

Subject to any mandatory rights or jurisdiction that cannot lawfully be excluded, the parties submit to the courts and tribunals having jurisdiction in Queensland, Australia.

For members located outside Australia, nothing in this clause is intended to exclude any mandatory legal rights that apply and cannot lawfully be excluded.
